DENVER (TheBlaze/AP) — A 6-year-old transgender child will be able to return to school after winning the right to use the girls’ bathroom, despite being born a boy.

The New York-based Transgender Legal Defense and Education Fund, which filed the complaint on behalf of parents Kathryn and Jeremy Mathis, announced the ruling in favor of Coy Mathis on Sunday.

The group claimed the first-grader was discriminated against by Eagleside Elementary School in Fountain, near Colorado Springs, after the school allegedly said Coy either had to use the bathroom in the teachers’ lounge or the nurse’s office after winter break.

Coy’s parents feared that going along would open the child up for bullying and chose to homeschool for the rest of the school year as the complaint was considered.

“All we ever wanted was for Coy’s school to treat her the same as other little girls,” Kathryn Mathis said. “We are extremely happy that she now will be treated equally.”

They said they later learned the child had gender identity disorder – a condition in which someone identifies as the opposite gender. The Mathises said they decided to help Coy live as a girl and the child subsequently came out of her shell.

“This is the first ruling in the nation holding that transgender students must be allowed to use bathrooms that match who they are, and the most comprehensive ruling ever supporting the rights of transgender people to access bathrooms without harassment or discrimination,” the group said in a news release.

Wow, the parents and the judge are freaks. The poor child is lost for sure.
And the other girls in the school? Guess they are the real losers here, really sick people out there and they seem to be the loudest mouthed ones.

Omgoodness what about the rights of the non transgender girls sharing the bathroom. They have rights too. Jeesh I am sorry but the constant politically correctness is just going a little bit to far.

Boy parts= boy bathroom and vice versa. So all the girls' rights are trampled on for the sake of this one little boy who already had an accommodation made previously.

This boy has been allowed to think he is a girl since he was 18 months old. Because he wanted a pink blanket and told his parents something was wrong with his body (@ 18 months having a conversation like that?)...so they take him to a doc who said.."Let him be a girl."

Am I the only one who is outraged that a 6 year old child is having an operation to change the gender he was born with???? the parents should be locked up for allowing it and pursuing it and the child should be put in to foster care and therapy! Or with sane family members... Sheesh!!!

There is no mention of any operation to change the gender of this child, you are all assuming something that isn't even part of the article.

I remember a story on Oprah about a boy (David Reimer) who had a botched circumcision. The doc came out and said basically that he accidentally cut off the baby's penis and to raise him as a girl...so they did. Boy had some major issues growing up because he never felt like a girl even though he didnt have a penis (anymore). Eventually story came out. Years later he committed suicide. Very tragic.

You are right, it does not mention an operation... however, I am still appalled the parents would fight for their male son to use the girls bathroom because he is gender confused! Instead of feeding into his confusion they need to give him clear guidance.

In cases like this she will probably receive testosterone blockers, until puberty, and then have sexual reassignment surgery after that. No doctor would perform that surgery, before the child had stopped growing.

By that time, if Coy has any doubts, then they'd likely not go through with the surgery. But, if she lived for the next twelve years as a girl and still identified with that gender, then sexual reassignment surgery would make sense.

As for the shock of the non-transgendered girls at that school, I highly doubt this is some sinister plot for Coy to be able to spy on the other girls in the girls' restroom.

No one would ever choose Coy's predicament, i.e. being born in the wrong body for her mental gender identity, so all in all, this sounds like an enlightened court decision.

I have a hard time believing an 18 month old starting complaining body parts were wrong, or whatever they say he said...Seems so suspicious to me...Even 6 YO doesn't go there emotionally that I've ever heard of. WEIRD.

i would think that by 6 they would definitely know that the child is showing signs of transgender. My problem is not with the parent supporting their child but going to the girls bathroom is pushing it to far for me. The child would have been better off going to the teachers lounge or the nurses office for the restroom. The lines are just getting pushed further and further back. Change everything to appease one and just because they are in the minority the majority should bend.

If he was the only boy in the set of triplets...(I believe at least one of the three is a girl), it is not far fetched to think he might feel outnumbered and confused. But who let's an 18 month old dictate anything?

If the parents were pushing it on her, then wouldn't she complain at school that her parents were forcing her to adopt the role of a female, instead of a male? Wouldn't she be anxious all of the time and upset, instead of "coming out of her shell" as the article noted? It sounds to me like she knew from a very early age that she did not identify as a boy.

I see no way that the parents could force this on her (nor why they would want to), without her complaining and acting out at school or elsewhere.

Another case of the needs of a minority should be placed ahead of the majority. Hopefully, he is a fussy little boy and won't leave a mess on the seat.

Both. The parents need to steer the child to how he was born. I doubt very seriously that a six year old child knows what a transgendor is without someone enforcing the thought.

Gender identity disorder is a documented condition, look it up. The parents can steer all they want, but if Coy has GID, then she will be miserable trying to live as a boy. It would be like sending your gay child to a conversion camp to "make" them straight. Apparently, there's not much success with that either.

Some days my toddler acts like a dog. Other days she spends the day as a cat. She is surrounded by boys all the time. The only female she is always around is me. She can climb a rock wall and loves the woodshop bench her grandpa gave her more than her play kitchen. The little boy that comes over to play has a penchant for taking her purses and wearing them. He has even put on her Cinderella slippers too. But he also plays baseball and wrestles with his big brothers and doesn't appear confused about being a boy and my tomboy also is very clear about being a girl.

I agree. Gender is not purely black and white. Women now wear pants, Scotsmen still wear kilts. Women can use power tools and some men can cook. But, GID is apparently much more extreme. I imagine a parent who had a child with that disorder would observe much more than a little bit of a tomboy or tomgirl predilection. Of course, there are psychiatrists and psychologists who can also assess whether something like GID is present.

Some folks are saying it isn't a big deal because the stalls are closed. What will happen in a few years when he has to take p.e. and is expected to shower and/dress out. Will he be allowed in the girl's locker room? How are parents going to be expected to be okay with their young teen girls sharing a locker room with will then be a teenage boy? Gay boys aren't currently allowed in the girl's locker rooms are they?

That's my concern. And, I would suspect bullying would be worse if one of the girls did happen to see that she has boy parts than it ever would be with a few trips to the nurse's office or teachers lounge.

I don't really see it as any different than a diabetic child having to make routine trips to the nurse's office to check their blood sugar or take insulin shots.
